By downloading, accessing, or using Cal Aide ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not download, access, or use the App.
These Terms constitute a legally binding agreement between you and Cal Aide ("we," "us," or "our").
2. Description of Service
Cal Aide is a health and fitness application that provides:
- AI-powered food tracking and calorie counting using photo recognition
- Personalized nutrition recommendations and insights
- Health plans (Smart Weight Loss, Muscle Builder, 16:8 Intermittent Fasting, Eat the Rainbow)
- Activity and step tracking (via Apple Health integration)
- Water intake tracking
- Weight management and progress tracking
- Daily, weekly, and monthly health insights
- Meal recommendations based on your goals
- Community food inspiration and discovery

Cal Aide is NOT a substitute for professional medical advice, diagnosis, or treatment. The App provides general nutrition and fitness information for educational and informational purposes only.
- Always consult with qualified healthcare professionals before making any health decisions
- Do not disregard professional medical advice based on information from the App
- The App is not intended to diagnose, treat, cure, or prevent any disease
- AI recommendations are based on general guidelines, not personalized medical advice
- We are not responsible for any health outcomes resulting from using the App
- In case of emergency, contact your doctor or emergency services immediately
4. User Accounts
4.1 Eligibility
- You must be at least 13 years old to use the App
- Users between 13-17 must have parental consent
- You must provide accurate and complete information
- You represent that you have the legal capacity to enter into these Terms
4.2 Account Creation
- You may create an account using Apple Sign In or email registration
- An account is required to use the App
- You are responsible for maintaining account security
- You must provide accurate information during registration
- One person may only create one account
4.3 Account Security
- Keep your login credentials confidential
- Notify us immediately of any unauthorized access
- You are responsible for all activities under your account
- We are not liable for losses from unauthorized account use
5. Subscription and Payments
5.1 Subscription Plans
Cal Aide offers the following subscription options:
- Monthly Subscription: Automatically renews every month
- Annual Subscription: Automatically renews every year
5.2 Billing and Payments
- All subscriptions are processed through Apple's App Store
- Payment will be charged to your Apple ID at confirmation of purchase
- Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current period
- Your account will be charged for renewal within 24 hours prior to the end of the current period
- The renewal cost will be clearly identified
5.3 Managing Subscriptions
- Subscriptions may be managed in your Apple ID Account Settings
- Auto-renewal may be turned off in Account Settings after purchase
- To cancel: Settings > [Your Name] > Subscriptions > Cal Aide > Cancel Subscription
- Cancellation takes effect at the end of the current billing period
- No refund for unused portions of the subscription period
6. Health Plans and Challenges
Cal Aide offers various health plans and challenges including:
- Smart Weight Loss: AI-powered calorie budget based on your goals
- Muscle Builder: Protein-focused nutrition tracking
- 16:8 Intermittent Fasting: Eating window management
- Eat the Rainbow: Nutritional variety tracking
These plans provide guidance and tracking tools but do not constitute medical advice. Results may vary based on individual factors.
7. User Content and Conduct
7.1 Your Content
- You retain ownership of content you submit (photos, food logs, etc.)
- Food photos you take for personal tracking remain on your device
- You grant us a license to use your content to provide and improve the service
- You are responsible for the accuracy of information you provide
- You represent that you have rights to any content you upload
7.2 Prohibited Content and Conduct
You may not:
- Submit content that is illegal, offensive, or harmful
- Violate any laws or regulations
- Infringe on others' intellectual property rights
- Upload viruses or malicious code
- Attempt to reverse engineer or hack the App
- Use the App for commercial purposes without authorization
- Create multiple accounts
8. Intellectual Property Rights
- The App and all content, features, and functionality are owned by Cal Aide
- Protected by copyright, trademark, and other intellectual property laws
- All rights not expressly granted are reserved
- You may not copy, modify, distribute, or create derivative works
- Unauthorized use of our intellectual property is prohibited
- The Cal Aide name, logo, and branding are trademarks of Cal Aide
9. Data Accuracy and Limitations
- We strive for accuracy but cannot guarantee 100% accuracy of nutritional information
- AI-generated food recognition is approximate and may contain errors
- Calorie and nutrition data should be used as estimates
- Meal recommendations are based on general guidelines, not your specific medical needs
- Always verify important nutritional information with reliable sources
- We are not responsible for decisions made based on App data
9A. Advertising and Analytics
We use third-party services to measure the effectiveness of our advertising campaigns:
- We use TikTok for Business SDK to track app installs and measure advertising performance
- These services may collect device identifiers and app interaction data
- On iOS 14.5+, we will request your permission via App Tracking Transparency before tracking
- You can opt out of tracking at any time through your device settings
- Opting out will not affect your ability to use the App

9B. Email Communications
By creating an account and using Cal Aide, you agree to receive email communications from us, including:
- Service Communications: Account-related emails such as welcome messages, password resets, subscription confirmations, and important service updates. These emails are essential for the operation of your account and cannot be opted out of.
- Marketing Communications: Promotional emails about new features, special offers, health tips, newsletters, and other content we believe may interest you based on your use of the App.
- Engagement Communications: Emails designed to help you achieve your health goals, including progress summaries, motivational content, and personalized recommendations.
9B.1 Your Consent
By providing your email address during account registration, you expressly consent to receive marketing and promotional emails from Cal Aide. This consent is given voluntarily and is a condition of using certain features of the App.
9B.2 Opting Out
You may opt out of marketing communications at any time by:
- Clicking the "Unsubscribe" link at the bottom of any marketing email
- Contacting us at feedback@calaide.com with the subject "Unsubscribe"
Please allow up to 10 business days for your request to be processed. Note that opting out of marketing emails will not affect your receipt of transactional or service-related emails.
9B.3 Email Frequency
We strive to send relevant and valuable content. Marketing emails are typically sent no more than a few times per month, though frequency may vary based on new features, promotions, or important updates.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind
- We do not warrant that the App will be uninterrupted, error-free, or completely secure
- We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
- We are not liable for any health outcomes resulting from use of the App
- Our total liability shall not exceed the amount you paid for the subscription in the past 12 months
11. Indemnification
You agree to indemnify and hold harmless Cal Aide, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.
12. Termination
- You may terminate your account at any time through the App settings
- We may suspend or terminate your account for violation of these Terms
- Upon termination, your right to use the App ceases immediately
- Data retention after termination is governed by our Privacy Policy
13. Changes to Terms
- We may modify these Terms at any time
- Changes will be posted in the App with an updated "Last Updated" date
- Material changes will be communicated via email or in-app notification
- Continued use after changes constitutes acceptance of new Terms
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.
15. Dispute Resolution
Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to waive any right to a jury trial or to participate in a class action.
16. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
